Sticker shock or what a crock?: Evaluating damages in personal injury cases in 2024
In line with the WDTL’s mission to assist attorneys new to the field of personal injury and automobile accident defense, this presentation will focus on different methods of evaluating damages after one has conducted discovery. We will discuss the distinction between medical bills for treatment versus diagnostic tests, excessive treatment, adjustments for deposition performance, age, accident severity, and many other factors that affect value. Analysis of settlement and jury verdict reports will be covered to include pointers for drafting verdict-range reports. Lastly, a case study will serve to illustrate the difficulty of evaluating an mTBI claim in 2024 when it seems like a new nuclear verdict is being reported every week. We will touch on the strategies used to negotiate the $250,000 policy limit demand (and bad faith threat that was accompanied by plaintiff's attorney associating with trial counsel) down to the $30,000 evaluation on the first day of trial… What a crock!

Levi Bendele is a civil defense attorney who defends insureds and insurance companies. He worked for State Farm claims in the late 90s and for the last 20+ years has defended a variety of cases, including automobile liability and UM/UIM, premise liability, construction injury and defect, premises liability, HOA litigation, professional liability, and insurance matters involving EUOs, PIP, coverage, bad faith and IFCA claims. He has been a member of WDTL since the early 2000s, was formerly a board member, and currently heads the Auto and Trucking Practice Group.
Maryam Nayibova has gained experience in a broad range of legal subjects, including personal injury, auto/trucking accidents and municipal liability. Maryam obtained her law degree from the Maurice A. Dean School of Law at Hofstra University in New York, where she was a notes and comments editor on the Labor and Employment Law Journal. In her free time, Maryam enjoys hiking, traveling, reading and exploring all that Washington State has to offer.
Mehreen Nadeem is passionate about the law and is dedicated to achieving outstanding outcomes for her clients. Prior to joining Lee Smart, Mehreen practiced in the areas of family law, residential and commercial real estate, finance, and compliance. She graduated from the University of Alberta with a Bachelor of Science with a specialization in Psychology. Mehreen then went on to earn her J.D. degree from the University of Houston Law Center in 2020. During law school, Mehreen represented her fellow students as an elected member of the Student Bar Association and was a position holder in negotiation competitions. She interned in a litigation position for the Harris County Attorney’s office and in an in-house counsel role for a real estate development company. Mehreen was also the recipient of the Houston Bar Association Real Estate Law Section Scholarship in law school. After law school, Mehreen obtained her license to practice law in Texas and Washington. In her free time, Mehreen enjoys traveling and spending time with family and friends.
