While most members of the Washington Bar were dealing with the daily demands of practicing law or taking time off to enjoy the one month of guaranteed sunshine in the Pacific Northwest, this past August Washington Defense Trial Lawyers (WDTL) rolled up their sleeves and gathered school supplies and backpacks for Treehouse.

Although the Leahy case appears to be the most extreme example, the duty of a UIM insurer is difficult for courts to apply and difficult to predict. On the one hand, the relationship is adversarial and the insurer may assert claims and defenses, but on the other hand the failure to accept the insured’s offered evidence is prima facie evidence of bad faith.
