Brian Augenthaler and Danielle Rogowski prevailed on a Motion to Compel a CR 35 examination of a Plaintiff who was refusing to travel to Vancouver, WA (from her home in Bend, OR) to attend an in-person medical examination for assessment of her claimed knee injury. After multiple attempts to accommodate the Plaintiff, who was demanding an examination close to her residence despite the fact she elected to file her claim in Washington, Defendants were forced to bring a Motion to Compel asking the Court to require the Plaintiff to “literally meet us halfway.”
 
King County Superior Court Judge Samuel Chung signed the proposed stipulation allowing Defendants to proceed with their examination and, most importantly, not be forced to find a new damages expert licensed in the State of Oregon on the eve of trial.
