On October 10, 2025, defense attorney Kimberly Reppart of Forsberg & Umlauf, P.S. obtained a defense verdict in a premises liability case tried in Whatcom County, Bradford v. Costco, Cause No. 21-2-00754-37. The case involved a Costco employee pulling a flatbed cart containing a dining room set through the warehouse. Plaintiff was walking toward the employee and turned aside just as he walked by. One of the boxes on the cart came into contact with the plaintiff’s shoulder. The plaintiff claimed ongoing injuries stemming from the August 4, 2018 accident.
The Costco employee testified he was pulling the cart rather than pushing it because the boxes created a blind spot directly in front of the cart and he was concerned a child might dart out in front of him. After scrutinizing the video of the incident, the jury determined neither party was negligent and that it was “just an accident.”
