Conflict in litigation is inevitable. And the way we approach conflict has a significant impact on the process as well as the outcome. We all have an inherent “conflict communication style”, formed by numerous factors.

This session will describe different conflict communication styles (e.g. Competing, Avoiding, Accommodating, Compromising, and Collaborating,) identify various tools one can use to determine their own style, and provide some examples and strategies for applying the different styles in negotiation.

Jason Rosen is a mediator/arbitrator who uses decades of experience handling civil tort cases to help parties craft effective and efficient settlements. His ADR practice includes personal injury/wrongful death, public entity liability, police action, employment discrimination, construction injuries, and product liability disputes.

Theresa Doyle is a mediator with Barrett Mediation. She retired from King County Superior Court in 2020, after 22 years on the bench.  As a judge, she served in every department and presided over hundreds of jury trials. She has presided over hearings in just about every type of civil case, including employment discrimination, wrongful termination, product liability, personal injury, medical and legal malpractice, will contests, estate matters, guardianship, premises liability, contract disputes, boundary disputes, commercial leases, real estate disputes, insurance coverage disputes, and insurance bad faith.

As a mediator, she has helped parties resolve many types of cases, including employment discrimination, motor vehicle torts, construction litigation, lease disputes, licensing disputes, police misconduct, neighbor boundary disputes, and intentional torts.

Karen Bamberger is a neutral at JAMS.  An experienced litigator for over 35 years, Ms. Bamberger has pivoted to using her skill set as a mediator/arbitrator to assist parties in resolving disputes.  She focuses on cases involving personal injury/wrongful death, product liability, insurance, real property, and civil rights.  As a mediator, she prides herself on using a collaborative communication style—and she’s not just saying that because of this CLE!

Hon. Dean S. Lum (Ret.) joined JAMS after a distinguished 23-year career on the King County (Seattle) Superior Court. As a trial judge, Judge Lum presided over hundreds of civil trials, heard thousands of civil motions, and conducted dozens of settlement conferences. He has skillfully handled numerous complex personal injury, malpractice, employment, partnership dissolution/valuation, class action/mass torts, product liability, and family law cases. As a judge and/or lawyer, Judge Lum gained extensive experience in complex commercial and insurance coverage and insurance bad faith cases and has been involved in many of the most significant Washington State insurance coverage cases of the past 30 years. While on the bench, he presided over dozens of bad faith, Insurance Fair Conduct Act, Consumer Protection Act, and coverage cases involving claims for professional malpractice, theft, construction delays, flooding, disease, and business interruption.
