Using Depositions and Trial Examination to Advance the Defense Theme
Effective cross-examination is grounded in preparation, discipline, and strategic consistency. This roundtable will examine how defense counsel can use depositions and trial examination to challenge witness credibility while reinforcing the overarching defense theme of the case, without alienating jurors, witnesses, or the court. Participants will discuss best practices for developing impeachment, securing clear testimony, and managing difficult or sympathetic witnesses through intentional questioning, careful sequencing, and professional restraint. The discussion will also address how deposition strategy informs trial cross-examination and how each examination decision should serve the broader defense narrative rather than isolated tactical wins.
