Navigating the Medicare Secondary Payer Act in Discovery & Settlement
Medicare liens frequently complicate and occasionally derail otherwise effective settlement negotiations. This is particularly true when the defense must rely upon plaintiff’s counsel to timely notify Medicare of the claim and obtain accurate lien information. Even after reaching a favorable resolution, insurance carriers often ask defense counsel to enforce highly nuanced and often inconsistent release language and payment instructions.
This roundtable will discuss ways to access lien information on the Medicare Portal (with or without an authorization from the plaintiff), reasons for using strong indemnification provisions, key regulations, and case law you may find helpful in negotiations, as well as real-life examples/cautionary tales.
