Protective Orders That Actually Protect
Protective orders are only as effective as the strategy behind them—and too often, they’re treated as boilerplate rather than a litigation tool. This roundtable will focus on how defense counsel can meaningfully protect sensitive information while advancing cases and avoiding discovery sanctions. Participants will discuss practical approaches to HIPAA-protected medical records, child safety and abuse-related files, proprietary business information, and social media evidence, including when to push for heightened protections, how to handle inevitable disclosure disputes, and how to respond when plaintiffs weaponize discovery to create leverage.
