Defense of Lithium Batteries Involved in a Fire

Rechargeable lithium batteries can fail and cause a fire, but they are often wrongfully blamed innocent victims.  This presentation will cover the fundamentals of lithium batteries, debunk commonly cited false hypotheses about failure, and discuss strategies for legal defense.  You will learn what causes lithium batteries to fail catastrophically, the significance of their appearance after a fire, how to handle manufacturing and design defect claims, and how to address jurors’ biases.

Presented by:

Tal R. Nagourney, Ph.D., CFEI, ESi Staff Consultant
Douglas Fleming, Partner, Fox Rothschild

Dr. Tal Nagourney is an electrical engineer specializing in fire investigation and failure analysis of lithium-ion batteries, consumer electronics, appliances, and semiconductor devices.

He has a wide range of hands-on engineering experience including electrical failure analysis, cleanroom microfabrication, micro-scale metrology, small-scale glass blowing, mechanical machining, and precision lapping and polishing. He applies his diverse engineering skillset and strong technical communication background to provide thorough analyses on the unique challenges posed by clients.

Dr. Nagourney is an accomplished researcher in the field of micro-electro-mechanical system (MEMS) design and fabrication. He conducted a comprehensive study on the nature of energy dissipation in blown glass micro-shell resonators for precision gyroscopes. The resonator performance enabled by his research remains unrivaled.

Douglas Fleming's practice centers on helping manufacturers to reduce risk when introducing new products and manage risk when problems arise with products in the field.
