On May 13, 2024, Phil deMaine and Brennen Johnson of Johnson Graffe Keay Moniz & Wick, and Tim Allen and Bryan Terry of Mullin, Allen & Steiner, received a defense verdict in the matter of Sedgley/Randall v. PeaceHealth et al. in Clark County, Washington. The case involved the medical treatment of the decedent plaintiff at PeaceHealth St. John’s Medical Center in Longview. The plaintiff had a long medical history of frequent ear infections and associated hospital visits. On March 3, 2021, the Plaintiff presented to St. John’s emergency department where it was determined that he was suffering from otitis media or externa, an outer and/or middle ear infection. Doctors prescribed antibiotic ear drops and discharged the Plaintiff home. Two days later, the Plaintiff returned, complaining of continued pain associated with his ear infection. After repeat imaging studies confirmed the original diagnosis, the Plaintiff was prescribed additional antibiotics and discharged for outpatient follow-up. The following morning, blood cultures collected during the Plaintiff’s second emergency department visit returned positive for streptococcus pneumoniae, indicating an infection in the blood stream. The Plaintiff returned to the emergency department on his own volition that morning and was transferred to Providence Portland Medical Center for intravenous antibiotic therapy and specialized ENT care. En route, the Plaintiff’s condition deteriorated significantly. Ultimately, the Plaintiff experienced transverse and sigmoid dural venous sinus thromboses and died on March 8, 2021. The Plaintiff’s estate alleged that the Plaintiff should have been admitted to St. John’s for intravenous antibiotics sooner, been prescribed different antibiotics, and been notified of his blood culture results sooner. After 12-day trial, following two years of significant motions practice, the jury returned a defense verdict in under 2.5 hours, finding no breach in the standard of care. The Plaintiff estate has appealed.
