Brandon Smith of HWS Law Group recently obtained a defense verdict for a general contractor who was alleged of improperly seeking disbursements from a construction loan and numerous construction defects. The general contractor originally sued to foreclose its after the construction loan was exhausted and the property developer refused to pay to complete the project and the balance owing. The developer countersued for construction defects and alleged that the general contractor had improperly sought draws from the construction loan without the developer’s approval. HWS sought and obtained verdict on several defects after the developer rested its case. In the end, the jury deliberated for two days before returning a verdict for HWS’s client, awarding 100% of its lien amount and denying each of the developer’s claims.
